The word “militia” is one of the most substituted terms in American English. Dusty muskets. Illegal gangs. Private armies. Laughing-stock weekend warriors. Almost none of that is what the Constitution, the statutes, or the historical record actually say.

Season 1, Episode 4 of Substitution of Terms. We finally get to the militia and the Second Amendment: the myths, the fairy tales, the propaganda, the history, and the parts of the American experience other countries kept — and some did not.
A well-regulated militia, in the Founding sense, is not a government hobby club and it is not a street gang. It is the people organized for defense. The Supreme Court in District of Columbia v. Heller, 554 U.S. 570 (2008), treated that prefatory clause as stating a purpose, not a permission slip that lets the state disarm the people and then declare the militia gone.
California did not ban “the militia.” The unorganized militia is still in the Military and Veterans Code. The federal definition is still in 10 U.S.C. § 246. What gets banned, smeared, or redefined are the words — until neighbors helping after a fire or a flood are treated as if they were a crime.
